Chronology :
On Sep 28, 2021, during routine review, Polaris found a social media post about brake light issues. An investigation was commenced (Oct ’21 to late-Mar ’22) resulting in Polaris’ determination that the brake light issue was caused by a software error in a supplier component, the Bosch ABS 9.1M Plus module. On April 9, 2022, the Polaris’ Executive Review Committee dispositioned the issue as inconsequential to safety, based on Polaris’ analysis including the brevity of the brake light illumination and that the issue only occurred under specific conditions, and there were no known crashes or injuries associated with the issue.
On April 13, 2022, Indian Motorcycle (Polaris) reported the noncompliance to NHTSA (later amending its report on Sep 9, 2022).
On May 13, 2022, Polaris petitioned NHTSA for a decision that the subject noncompliance was inconsequential to motor vehicle safety, detailing the particular circumstances in which the brake lighting issue occurred and citing to granted petitions for similar lighting issues.
On Jan 26, 2024, Polaris received notice from NHTSA that the petition was not approved. On Feb 2, 2024, Polaris filed the Noncompliance Notice 573 Report upon receiving the notification of NHTSA’s determination regarding the petition.
The initial reported affected population was 12,619 vehicles (reported on the April 13, 2022, Form 573). This number is now reduced by 971 vehicles where Polaris has confirmed these vehicles have already received the software update (e.g., via routine service visits or updated while in manufacturer control) or have never been transported beyond the direct control of Polaris.
Polaris, adhering to NHTSA’s decision, initiates this recall for 11,648 vehicles.
