Taillights May Fail to Illuminate
Taillights that fail to illuminate may reduce the visibility of the vehicle to other drivers, increasing the risk of a crash.

Summary
Nova Bus (US) Inc. (Nova Bus) is recalling certain 2022 LFS vehicles. The taillights may fail to illuminate when the headlights are activated. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 108, “Lamps, Reflective Devices, and Associated Equipment.”
Remedy
Nova Bus will update the vehicle software, free of charge. Owner notification letters were mailed April 24, 2023. Owners may contact Nova customer service at 1-800-350-6682. Nova’s number for this recall is CR5397.

Program V-BEA system
Tail light don’t work in night run mode. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 108, “Lamp, Reflective Devices, and Associated Equipment.”
Program the V-BEA system with the program and revision indicated in the client listing or the one recommended by your customer support manager. See section 16: V-BEA (Volvo bus electronic architecture) of your maintenance manual for the programming procedure.

2023-02-23 A customer informs Nova Bus of a tail lamp issue and a field report is created.
2023-03-07 Nova Bus Product Safety Working Group is informed of the issue and opens an investigation.
2023-03-09 Nova Bus Product Safety Working Group 1st evaluation.
2022-03-23 Nova Bus Product Safety Working Group decides to raise this situation to the Nova Bus Product Safety Committee. 2023-03-28 Nova Bus Product Safety Committee determines a regulatory non-compliance exits.
2023-04-04 Nova Bus submits a vehicle recall report to NHTSA. Nova Bus has not received any property damage claim, and neither notice or claim of injury or death associated with this defect.

This notice is sent to you in accordance with the National Traffic and Motor Vehicle Safety Act.
Nova Bus (US) Inc. has decided that certain Nova Bus models LFS, model year 2022 fail to conform to Federal Motor Vehicle Safety Standard No. 108; Lamps, reflective devices, and associated equipment.
Nova Bus (US) Inc. have voluntarily submitted the Vehicle Recall Report to NHTSA that generated the Safety Recall 23V239.
The service document CR5397 explaining the measures to be taken to remedy the affected vehicles will be published on its web site https://us.novabus.com/customer-portal/. The vehicle can be remedied starting from April 2023. At this time, the remedy as already been completed and implemented on all affected vehicles. The remedy took approximately 20 minutes to complete. The necessary replacement parts will be available via the Nova Bus Parts distribution network. Nova Bus (US) Inc. will assume the parts and labour costs of the repair according to the warranty claim policies in effect.
The affected vehicles may have under certain conditions, inoperative tail lamps may reduce the vehicle visibility and increase the risk of a crash from following vehicles. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 108, “Lamps, Reflective Devices, and Associated Equipment.” Nova Bus will provide a service document to reprogram the vehicle software. All costs associated with this corrective measure will be covered by Nova Bus.
Any lessor who receives a notification of a determination of a safety-related defect or noncompliance pertaining to any leased motor vehicle shall send a copy of such notice to the lessee. This requirement applies to both initial and follow-up notifications but does not apply where the manufacturer has notified a lessor’s lessees directly.
You may be eligible to receive reimbursement for the cost of obtaining a pre-notification remedy of a problem associated with this Safety-Related Defect. Please submit copies of all documentation supporting your claim according to the requirements specified in the “General Plan for Reimbursement of Pre-notification Remedies” provided in this notification in Annex B.
After contacting your customer support manager, if you are still not able to have the Safety-Related Defect remedied without charge and within reasonable time, you may submit a complaint to the Administrator, National Highway Traffic Safety Administration, 1200 New Jersey Ave., SE., Washington, DC 20590; or call the toll-free Vehicle Safety Hotline at 1-888-327-4236 (TTY: 1-800-424-9153); or go to http://www.safercar.gov .

General Plan for Reimbursement of Pre-Notification Remedies
When a Nova Bus vehicle is affected by a Safety Recall and the owner/purchaser (claimant) has the Safety-Related Defect or Noncompliance remedied at their own expense prior to receiving the manufacturer notification, Nova Bus (US) Inc. will reimburse the owner/purchaser for the reasonable amount paid (i.e. the cost of parts, labor, disposal fees and taxes) that addressed the Safety-Related Defect Noncompliance as described in the notification. To qualify, repairs must have been completed no earlier than one year prior to the release of the Safety Recall (notification to NHTSA) and no later than 10 days after the last mailing of the owner notification letters.
All claims must be accompanied by accurate and complete documentation (the invoice/receipt must provide the VIN, date of repair, total amount paid and include a breakdown of the parts, labor, and other costs. Specific costs associated with this notification must be highlighted or circled on the invoice).

Description of the Safety Risk : Under certain conditions, Inoperative tail lamps may reduce the vehicle
visibility and increase the risk of a crash from following vehicles. Nova Bus has not received any property damage claim, and neither notice or claim of injury or death associated with this defect. Therefore, we consider this as a proactive measure to protect the public from the potential safety risk associated with this defect.
Description of the Cause : The root cause is a vehicle software (VBEA) programming error. Identification of Any Warning
that can Occur : The inoperative tail lamps may be detected during the commercial vehicle pre- trip inspection.

2023-02-23 A customer informs Nova Bus of a tail lamp issue and a field report is created.
2023-03-07 Nova Bus Product Safety Working Group is informed of the issue and opens an investigation. 2023-03-09 Nova Bus Product Safety Working Group 1st evaluation.
2022-03-23 Nova Bus Product Safety Working Group decides to raise this situation to the Nova Bus Product Safety Committee. 2023-03-28 Nova Bus Product Safety Committee determines a regulatory non-compliance exits.
2023-04-04 Nova Bus submits a vehicle recall report to NHTSA. Nova Bus has not received any property damage claim, and neither notice or claim of injury or death associated with this defect. Description of Remedy :
Description of Remedy Program : Nova Bus will provide a service document to reprogram the vehicle
software. All costs associated with this corrective measure will be covered by Nova Bus. The updated software is already available to the single customer affected thru the service representative. Pre-notification remedies will be addressed using the Nova Bus general reimbursement plan on file with NHTSA. How Remedy Component Differs from Recalled Component :
Identify How/When Recall Condition was Corrected in Production : The vehicle software secific to this vehicle lot have been corrected with the proper parameter.
