After a preliminary review of consumer complaints and other information related to alleged defects, NHTSA obtains information from the manufacturer(including data on complaints, crashes, injuries, warranty claims, modifications, and part sales) and determines whether further analysis is warranted. If warranted, the investigator will conduct a more detailed and complete analysis of the character and scope of the alleged defect.

Component Description: ELECTRICAL SYSTEM:IGNITION
Summary Description: Motorcycle Stalling
Summary
On March 3rd 2017 the Office of Defects Investigation (ODI) opened this Preliminary Evaluation (PE17-001) to investigate allegations of stalling when accelerating from a stop on 2014-2015 DL1000 Suzuki motorcycles.ODI contacted 4 of the 5 consumers who had filed complaints with the office and learned they all could engage the clutch as the stalling condition presented itself and keep the bike in an upright, stable position. On May 17th 2017 Suzuki
responded to ODI's Information Request letter and informed ODI of 21 consumer complaints and 28 warranty claims alleging stalling while accelerating from a stop on 2014 and 2015 subject vehicles.Additionally, Suzuki
made ODI aware of three crashes where the consumer alleged they dropped the bike as a result of the stall (no injuries were reported).ODI contacted the complainants, including the consumers alleging a crash and noted the majority alleged a misfire or a loss in power at cruising speeds or going around a turn. These allegations were not consistent with the alleged defect of this investigation.Furthermore, ODI learned from 2 of the 3 complainants alleging a crash (dropped bike) that they had installed after market equipment on the motorcycle altering its performance and/or fueling strategy. On July 27th, 2017 Suzuki
and ODI participated in a joint ride-evaluation of the subject motorcycles.Suzuki
supplied ODI with a 2014 and 2015 D1000 motorcycle with original factory settings.ODI solicited assistance from the Virginia State Police (VSP) Division 7 Motor Squad to evaluate and ride the subject motorcycles at the Dulles Airport training grounds.VSP supplied ODI with 4 professional and experienced motorcycle riders. At the Dulles location, ODI created a repeatable test program that would best elicit the alleged defect. The test was a series of accelerating patterns through first gear into second at different distances. After a total of 5 hours of riding the VSP riders were unable to induce or duplicate the stalling condition (alleged defect). On August 9th 2017 Suzuki
met with ODI to discuss the investigation, the merits of the complainants, and give a presentation concerning the chronology of design changes associated with the subject vehicles. As a result of the July 27th ride evaluation, the August 9th joint meeting, and investigative interviews, ODI has concluded the alleged defect of this investigation does not present an unreasonable risk to motor vehicle safety at this time.In addition, Suzuki
has agreed to provide its customers with an updated engine control module (ECM) via a service campaign TLSVDL 066 (ODI 10119582) incorporating the latest engine software.ODI is closing this PE as further use of agency resources does not appear to be warranted. The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist. The agency reserves the right to take further action if warranted by the circumstances.

Manufacturer’s Name: Ford Motor Company
Component Description: STEERING
Summary Description: Champion Ford Edinboro / Steering Shaft
Summary
NHTSA opened AQ17-001 to determine whether Champion Ford Edinboro, Inc. (Champion Ford
), of Edinboro, Pennsylvania, complied with the requirements of the National Traffic and Motor Vehicle Safety Act, 49 U.S.C. Chapter 301 (Safety Act) and its implementing regulations. The Safety Act requires, among other things, that a manufacturer notify its dealers of defects related to motor vehicle safety and non-compliances with Federal Motor Vehicle Safety Standards and, in turn, that a dealer not sell a new vehicle subject to a recall unless the recall remedy has been performed (49 U.S.C. ?30120(i)).NHTSA issued an information request (IR) letter to Champion Ford
on January 4, 2017.Champion Ford
responded to this request on January 19, 2017.Also on January 4, 2017, an IR letter was issued to Ford
Motor Company (Ford
) and a response was received from Ford
on January 25, 2017.Finally, another IR was issued to Champion Ford
on May 31, 2017, and Champion Ford
's response letter was submitted to NHTSA on June 14, 2017.NHTSA's investigation indicated that Champion Ford
did sell and deliver recalled vehicles that did not have the recall remedy completed at the time the vehicles were delivered to the customers.NHTSA therefore concluded that Champion Ford
was liable for civil penalties for violations of the Safety Act, pursuant to 49 U.S.C. ?30165.Under a Settlement Agreement dated April 16, 2018, Champion Ford
agreed to pay compromised civil penalties in the amount of $20,000.Champion Ford
also represented in writing that it repaired all twenty-three (23) recalled vehicles identified in AQ17-001 and will strictly adhere to Ford

Manufacturer’s Name: Hyundai Motor America
Component Description: SEAT BELTS:FRONT:ANCHORAGE
Recall Campaign: 17V152
Summary Description: Front Passenger Seat Belt Anchor Failure
Summary
The Office of Defects Investigation (ODI) opened this investigation on December 27, 2016 based on two ODI consumer complaints reporting a failure of the front passenger seat belt to remain connected to the seat belt anchor and pre-tensioner during a crash. On March 8, 2017 Hyundai Motor America (Hyundai
) filed a defect report with the agency stating that it would conduct a safety recall on 977,778 model year 2010-2014 Sonata vehicles produced from December 11, 2009 through May 29, 2014 and model year 2011-2015 Sonata Hybrid
vehicles produced from December 2, 2010 through January 9, 2015.The remedy for the recall was to inspect the front seat belt anchor connector for proper attachment to the seat belt pre-tensioner.ODI continued the investigation in order to pursue a remedy that would be more lasting, rather than a one-time inspection. The connector is designed so that it can be removed from the pre-tensioner, when required, during vehicle maintenance. If it is not properly connected when originally installed or when re-installed after maintenance, the connector could potentially release in a crash. On September 4, 2017 Hyundai
filed an amended defect report and advised the agency that the remedy would be modified to provide a permanent label, to be attached to the connector, at the time of inspection. The label provides graphic instructions and illustration as to the proper orientation of the connector lock when it is properly installed. On October 4, 2017 Hyundai
filed an additional defect report (see 17V-671) to have the vehicles that have had only theinspection procedure performed return to dealers to have the permanent label applied to the connector.ODI is closing this investigation based on Hyundai
's recall action to add a permanent label to the connector. This preliminary evaluation is closed. The ODI reports cited above can be viewed at www-odi.nhtsa.gov/complaints under the following identification numbers: 10903469 and 10926737.

Manufacturer’s Name: Nissan North America, Inc.
Component Description: SERVICE BRAKES, HYDRAULIC:FOUNDATION COMPONENTS:MASTER CYLINDER
Summary Description: Scope of Recalls 08V311 and 09V431
Summary
Nissan conducted safety recalls 08V-311 and 09V-431 to remedy leaking master cylinders on certain MY 2007 and 2008 Nissan
Sentra vehicles. The recall populations were determined based on production changes to the master cylinder which were fully implemented into production on April 18, 2008.NHTSA utilized vehicle owner questionnaire (VOQ) reports and did not request field information from Nissan
.ODI identified two MY 2008 Nissan
Sentra VOQs including the petitioner?s vehicle, which were not covered by the recalls and reported a leaking master cylinder. Both of these incidents occurred 6 or more years into the service life of the vehicle.ODI also identified three VOQs which reported a leaking master cylinder after receiving the recall remedy. While one of these failures occurred within 36 months of the recall remedy, the other two occurred at a later time.ODI notes that the original recall addressed failures which occurred early in the life of the vehicle, typically during the first 36 months of service.Master cylinders are generally expected to experience wear and thus will display a finite service life. After a thorough review of the available data in NHTSA's VOQ database, the agency has not identified a trend that would call into question the scope or adequacy of Nissan
's recalls.Accordingly, and in view of the need to allocate and prioritize NHTSA's limited resources to best accomplish the agency's safety mission, ODI is denying the petition.A detailed summary of ODI's analysis of this petition is available in the investigative file for this action, and will be published in the Federal Register also. The agency reserves the right to revise this assessment should future circumstances warrant. The VOQs cited above can be viewed at NHTSA.gov under the following reference numbers: 10299791 10330891 10449038 10567372 10638813 10805749 10839357

Component Description: SERVICE BRAKES
Summary Description: Extended Braking Distance
Summary
On December 20, 2016, the Office of Defects Investigation (ODI) opened Preliminary Evaluation (PE) 16-017 to investigate reports of braking concerns in model year 2007 through 2009 Ford Fusion and Mercury
Milan vehicles.Complainants report that after an ABS
braking event (caused by braking on a slippery or uneven surface) the brake pedal moved towards the floor and the distance in which the vehicle stopped increased beyond what was expected by the driver. The cause of the problem appears to be the Antilock Braking System (ABS
) Hydraulic Control Unit (HCU), a component manufactured for Ford
by Continental
Automotive Systems.Hydraulic control valves within the HCU can experience corrosion and become stuck. In some cases, braking returns to normal when the valve(s) subsequently become unstuck. The intermittent condition proves difficult to diagnose and complainants report having several brake system components replaced only to have the condition return.ODI has identified 544 reports submitted to the agency that relate to this issue in model year 2006-2012 Ford
Fusion/MKZ and MY 2006-2011 Mercury
Milan, the subject vehicles.Complainants report an increase in pedal travel which in some cases resulted in going past expected stopping points or having to steer to avoid contacting another vehicle; twenty six report a crash with 3 injuries alleged. The Ford
reports shown above, which are from PE16-017 and involved the scope discussed above, were similar in content and identified 7 crashes without injury.During PE16-017, ODI was able to recover HCUs from some complaint vehicles, including some from the reported crashes. The recovered HCUs were sent to NHTSA's Vehicle Research and Test Center (VRTC) in East Liberty, Ohio for evaluation.VRTC was able to confirm stuck valves and corrosion of the zinc coated control valves, and it's testing indicates that HCU failures cause increases in pedal travel that may affect braking distance.According to Ford
, newer version HCUs have a different coating on the affected valves that do not currently appear to be experiencing corrosion. In it's response to ODI's information request letter, Ford
described analysis of two failed HCUs removed from complainant vehicles. In both cases, a gelatinous material found inside the HCU prevented control valves from properly returning to the closed position after actuation.Ford
found that an interaction between the valve coating and brake fluid
was the likely source of the gelatinous material. It acknowledged that stuck valves can result in increased pedal travel but maintains the affected brake circuit will develop pressure and respond if the brake pedal is pressed sufficiently. While it has not identified an unreasonable risk to safety due to this issue, Ford
states that it continues to investigate the possible causal and contributory factors including additional engineering evaluations and testing. An Engineering Analysis has been opened to assess the scope, frequency, and safety-related consequence of the alleged defect.Based on information received during PE16-017, the scope of the investigation has been increased to include another model, the Lincoln
MKZ, and to expand the model years of the subject vehicles.
