Summary

NHTSA received a letter from the Center for Auto Safety (CAS) on March 21, 2019 alleging that the Automatic Emergency Braking (AEB) system on Model Year (MY) 2017-2018 NissaneBay Rogue and Rogue Sport vehicles was engaging in cases where there was no obstruction in the path of the vehicle. The CAS petition additionally alleged that, based on NissaneBay's actions, the manufacturer was aware of the issue due to issuing a Technical Service Bulletin (TSB) launching two Quality Actions, and initiation of a Customer Service Initiative in relation to it. CAS contended that NissaneBay's actions do not represent an adequate long-term solution to the problem, as the action is only available during the basic coverage period of the warranty. CAS also argued that the alleged failures are an unreasonable risk to safety and views NissaneBay's communications as not acknowledging the potential safety issue involved, instead treating the alleged problem as a performance update.The Office of Defects Investigation (ODI) analyzed Vehicle Owner Questionnaire (VOQ) complaints received from consumers and identified a total of 129 unique subject vehicle reports (for all submission dates) alleging a false positive triggering of AEB. Of these complaints, three were identified that contained allegations of a collision resulting from the activation of the system, and all three indicating related injuries.In response to ODI's April 15, 2019 Information Request letter, NissaneBay provided data indicating that it has received 750 unique subject vehicle complaints relating to false positive activation of the AEB system. Of these complaints, 12 were identified that contained allegations of a collision resulting from the activation of the system. Four complaints contained allegations of injuries, three of which were the result of a collision. These complaints included duplicates of complaints that ODI received. The injury allegations were limited to soft tissue type injuries such as whiplash and bruising.Based on its review of the information identified to date, ODI grants this petition and has opened preliminary evaluation PE19-010 in order to evaluate the cause, scope and frequency of AEB false positive activations, as well as to evaluate the suitability of the manufacturer's campaign to address the concern or improve performance of the AEB system. Summary

The Office of Defects Investigation (ODI) opened investigation PE19-002 on March 25, 2019. This investigation was opened based on six consumer complaints alleging 2018 and 2019 BMWeBay K-1600 motorcycles were unstable at highway speeds and that the instability was exacerbated while in traffic.ODI opened the PE to determine the severity and frequency associated with the alleged defect.In response to an ODI Information Request (IR) letter, BMWeBay submitted a total of 20 complaints, 15 field reports and 5 warranty claims. Although the subject vehicles of the investigation include 2018 and 2019 model years, all the complaints, warranty and field reports submitted by BMWeBay were on the 2018 MY bikes.BMWeBay stated in its response that it did not have any complaints, warranty or field reports for the 2019 MY K 1600 series. Since opening the PE, ODI has received an additional six consumer complaints related to this investigation.In July 2019, ODI met with BMWeBay at its New Jersey facility to see a presentation and then follow (in a trailing vehicle) a BMWeBay rider on a subject bike. The purpose of the trailing exercise was to observe how the motorcycle handled on various road types and traffic conditions. During this demonstration the ODI investigator witnessed some instability or ?wobble? that was aggravated when passing large trucks. There were, however, no lane departures experienced by the subject vehicle?s rider during the trailing event. The ODI investigator was unable to fully determine the safety impact of the observed phenomena.In addition to witnessing the BMWeBay rider demonstration in New Jersey, ODI interviewed complainants who allege their bikes felt unsafe and were dangerous above 55 mph. To better understand the safety impact described by consumers and quantifiably measure the level of instability experienced, ODI has decided to upgrade the investigation to an Engineering Analysis (EA). As part of the EA, ODI will conduct an analysis of the subject motorcycle?s geometry, suspension and other characteristics as well as conduct stability testing. ODI will have the subject motorcycle tested at NHTSA's Vehicle Research Testing Center (VRTC) under controlled conditions to both quantifiably and subjectively measure the subject motorcycle?s stability. Summary Description: Roof Skin Separation While Driving


Summary

On August 23rd, 2018 - the Office of Defects Investigation (ODI) received a media inquiry pertaining to a motorist experiencing separation of the roof skin from their CadillaceBay XLR while driving.Based on the data in-hand at that time and a subsequent (December) consumer complaint, ODI opened PE19-001 on February 1, 2019 to evaluate the scope of this condition in the 2004 - 2005 XLR population.The subject vehicle model is a two-seat roadster equipped with an electrically powered retractable roof system. The outer roof skin is a Sheet Molded Composite (SMC) which is adhered to the magnesium alloy roof frame.ODI's February 7, 2019 Information Request (IR) letter to General MotorseBay (GM) covered the entirety of XLR production: MY 2004 - 2009. GM's March 21, 2019 IR response attributed the separations to an unexpected oxide layer on the magnesium framework. A total of eight separations were identified, six of which coincided with consumer complaints to NHTSA. Separations occurred at two per calendar year with the most recent taking place in late 2018.An additional twenty-one noise, fit/finish/ functionality claims were identified that did not lead to separations.ODI compared the separation rate in the subject vehicles to those in to two roof skin separation safety recalls involving the Corvette (06V181: 2005 - 2006 Corvette; 09V491: 2005 - 2007 Corvette) to find that the subject vehicles took over ten years of exposure to reach the failure rate that triggered the 06V181.Since PE19-001 opened, ODI has received only one additional consumer complaint which reported wind noise symptoms. The complainant has not responded to outreach efforts by ODI or GM.Based on a low failure rate, sporadic occurrence, and high detectability of the alleged defect in the subject vehicles, this investigation is closed. Further use of agency resources on this matter is not warranted. The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist in the subject vehicles.The agency reserves the right to take further action if warranted by the circumstances.
