On August 29th 2011 the Office of Defects Investigations (ODI) opened this Preliminary Evaluation (PE11-028) on Daimler Trucks North America (DTNA) for output shaft failures located in the forward-rear axle carrier
of certain class 8 vehicles equipped with Arvin Meritor
RT series output shaft assemblies.At the time of this (PE) opening, ODI was aware of a field campaign and two field reports thought to be related to this alleged safety concern.The DTNA campaign address a risk resulting from an incorrect heat treatment process of the output shaft (SF441AB); which was initially believed to be associated with the two field reports.On October 21st 2011 ODI received DTNA's PE Information Request (IR) letter response which indicated no additional complaints or field reports related to the alleged defect.ODI also learned that the two original field reports noted in the opening resume were U-joint failures and were unrelated to the service campaign. DTNA claimed a total of 96 warranty claims, all related to performing the service campaign but unrelated to any field failures. Upon receiving DTNA's PE-IR letter response ODI learned that even if a fracture were to occur in relation to the alleged defect, it would be located at the base of the splined section of the shaft opposite the output yoke and inside the axle housing.The Output shaft assembly is bolted into the axle housing and will remain secure in the event of a fracture. Based on the fact that there are no consumer complaints, injuries or field reports and the benign consequence of the alleged defect, ODI is closing this investigation.ODI will continue to monitor this field campaign.

CX-9 vehicles.In response to ODI's information request letter, Mazda
identified a problem with the manufacturing process for the master cylinder primary plunger that could result in inappropriate surface finish.ODI's analysis of complaints and field reports determined that the problem was isolated to several months late in the production of the MY 2008 CX-9 vehicles.Mazda
indicated that changes to the plunger machining and inspection processes were incorporated late in MY 2008 vehicle production (June 25, 2008).There are no confirmed failures related to the condition in subsequent production.The subject master cylinder was used by Mazda

In response to the Office of Defects Investigation's (ODI) Information Request (IR) for PE11-025, BMW provided ODI with 1 complaint and 46 field reports relating to either incidents of unattended vehicle rollaway or vehicle movement after the driver expected the vehicle gearshift to automatically shift to park. ODI's analysis of the data provided by BMW
identified 14 crashes and 5 alleged injuries. ODI has also identified 3 additional reports in its database alleging vehicle rollaway incidents of which 2 resulted in crashes.The subject vehicles are all equipped with push-buttons (Start/Stop button) to control starting/stopping the engine and Shift-by-Wire gearshift systems controlled by a column mounted selector lever behind the steering wheel. The Start/Stop button also controls switching the ignition and the radio ready state On and Off. Shift-by-wire systems replace the traditional mechanical connection (e.g., cable or linkage) between the gearshift and automatic transmission with an electronic connection controlled by a computer module. When parking the vehicle, the driver has the capability to manually shift the vehicle to park by pressing the Park button on the end of the electronic gearshift lever. However, the instructions for engine shutoff provided in the owner's manual state that pressing the Start/Stop button serves the dual function of switching off the engine and automatically shifting the transmission to Park.In response to ODI's information request for PE11-025, BMW
described several circumstances where the subject vehicles may shift to neutral when the driver may expect it to automatically shift to park. First, for Comfort Access System (CAS) vehicles, if the transmission is in neutral when the key fob is in the ignition slot and the Start/Stop button is pressed to shut-off the engine, the transmission will remain in neutral. This is referred to as the Carwash mode and is a normal operating feature of the vehicles that is described in the owner's manual. BMW
also described two circumstances that are not normal operating features and are not described in the owners' manual: (1) with the transmission in drive or reverse and the engine running, if the Start/Stop button is pushed 2 or 3 times within a 0.3 second to 0.5 second interval, the engine will stop and the transmission will shift to Neutral; and 2) if the Park button on the gearshift lever is pressed at the same time that the gearshift lever is actuated (i.e., toggled up or down) to select drive, reverse or neutral; the transmission will shift to neutral or remain in neutral.Beginning in model year (MY) 2005, BMW
introduced CAS as an optional feature package for the subject vehicles.The key for CAS equipped vehicles is an electronic code that is sent to the engine control module by a remote transmitter (key fob). An optional docking port (key slot) is provided for driver convenience or to put the vehicle into Car Wash mode, which allows for engine shutoff in neutral. BMW
sold approximately 45,000 subject vehicles with CAS and approximately 94 percent of the CAS equipped vehicles were produced from MY 2006 through 2008. On February 23, 2011, Accuride Corporation notified the NHTSA that it had decided certain Gunite branded automatic slack adjusters contain a safety related defect.Accuride stated that certain slack adjusters, manufactured between October 15, 2010, and January 31, 2011, contain inadequate structural integrity at the slack adjuster housing due to inadequate knitting of the iron at the time of casting.This inadequate structural integrity could cause the housing to break at the handle under normal operating loads.If the slack adjuster were to break, the wheel brake to which the slack adjuster is attached would no longer function, causing the vehicle to have reduced braking capacity and, if mounted on the steer axle, the vehicle could pull to one side, possibly resulting in a crash.This issue was assigned recall number 11E-008.Accuride's Defect Report also contained a purchaser list of vehicle manufacturers who were sold these slack adjusters.On August 4, 2011, NHTSA's Recall Management Division opened an equipment query (EQ) for this issue in order to write to these affected vehicle manufacturers.On September 8, 2011, RMD mailed information request (IR) letters to 15 manufacturers notifying them of the Accuride safety recall and requesting they conduct a safety recall for any new motor vehicles they manufactured with these slack adjusters.On November 3, 2011, RMD mailed a 2nd IR letter on November 3, 2011 to 5 manufacturers who did not respond to the first letter.Autocar Industries, Inc., Beall Transport of Montanna, and Kalmar Industries Corp., responded that their units were only sold into the aftermarket.These units would be covered under Accuride's safety recall.Manac Inc. and Polar Tank Trailer, LLC., responded that their only affected units were shipped to Canada and, thus, no U.S. safety recall is necessary.MAC Trailer Mfg., Inc. responded that the units they received did not fall within the production dates that Accuride recalled.Road Systems Incorporated responded that their affected inventory was returned to Accuride and no motor vehicles were affected.Three companies did not file sufficient responses to RMD's IR letters.Despite additional correspondence through phone calls and e-mails, Alfab, Inc. and Peerless Limited did not file a written response with RMD.E.D. Etnyre & Co. mailed RMD a large packet of notification letter copies and recall remedy receipts that they collected in the course of Accuride's recall.When RMD explained the regulatory requirement that E.D. Etnyre & Co. must notify the NHTSA of its defective vehicles via a Part 573 Defect & Noncompliance Information Report, the company chose not to respond.These three companies will be referred to NHTSA's Office of the Chief Counsel for further enforcement action.In total, five manufacturers responded to RMD's IR letters by submitting Defect Reports and conducting safety recalls for their affected vehicles.Those companies are listed below:11V-479 - Silver Eagle 11V-481 - Wilson Trailer Company 11V-488 - Transcraft Corporation 11V-555 - Mertz Manufacturing LLC 11V-601 - Rosa Trailer Mfg.As RMD received adequate responses from all but three companies (as noted above), this Equipment Query is closed.
