Summary

On June 11, 2015, JaguareBay-Land RovereBay (JLR) submitted a Defect Information Report (DIR) to NHTSA describing a defect condition in the electronically controlled door latch systems of approximately 65,372 model year (MY) 2013-2016 Range Rover and MY 2014-2016 Range Rover Sport that may result in incidents of door opening while driving (NHTSA Recall No. 15V-385, JLR Recall P068).On August 4, 2017, the Office of Defects Investigation (ODI) opened Recall Query RQ17-005 to investigate claims of doors failing to latch and/or inadvertently opening while driving (latch malfunctions) on MY 2013-2016 Range Rover and MY 2014-2016 Range Rover Sport vehicles that had received the remedy for 15V-385 or were built after the recall remedy had been implemented in production (the subject vehicles). ODI has received 5 unique reports (VOQs) related to the alleged defect in the subject vehicles. All five VOQs allege experiencing at least one incident of a door opening inadvertently while the vehicle was in motion and were repaired by replacing the malfunctioning latch assembly. One minor injury was reported where the consumer did not seek medical care.ODI's analysis of information provided by JLR in response to the Information Request (IR) letter for RQ17-005 identified 43 additional complaints and field reports related to door latch malfunctions in the subject vehicles, including 14 additional allegations that a door opened while the vehicle was in motion. In addition, ODI's analysis of JLR warranty claim data provided in the IR response identified an additional 564 vehicles that received latch replacements to address customer concerns with latch malfunctions, including 72 additional incidents of doors opening while in motion based on ODI's analysis of customer concern narratives.ODI has upgraded this investigation to an Engineering Analysis (EA18-004) to further assess the recall remedy, scope, and frequency. Summary Description: Exhaust Odor in Passenger Cab


Summary

During the EA17-002 investigation, the agency reviewed and analyzed reports of exhaust odors in the passenger cabins of Model Year 2011 to 2017 FordeBay Explorers. This investigation required an approach that incorporated knowledge and expertise from the automotive, medical, environmental health, and occupational safety fields. The agency conducted an in-depth investigation that encompassed the review of over 6,500 consumer complaints, conducting field inspections, and testing the relevant vehicles, both independently and in coordination with FordeBay and other entities. During the investigation, the evolution of FordeBay service bulletins intended to reduce the level of exhaust odors and carbon monoxide (CO) entering the occupant compartment was examined and independent tests to evaluate the effectiveness of the final Field Service Actions (FSA) for both consumer and police vehicles were conducted. As part of the investigation, the agency also examined the effects of cracked exhaust mani-cats on the measured CO levels in the vehicles and tested the FSA repairs to ensure they did not adversely impact occupant compartment CO levels due to cracked mani-cats.The investigation identified upfitting issues for Police Interceptor vehicles. Upfitting (sirens, lights, cages, auxiliary power, etc.) is typically performed by governmental fleet operations, independent repair facilities, or local FordeBay dealers after the sale of the new vehicle. Sealing issues caused by upfitting were responsible for the highest measured carbon monoxide levels in tested vehicles. The police FSA instructs how to inspect the quality of the vehicle upfits and how to properly seal any leaks caused by these upfits, at no cost to the police agency. Similarly, the highest CO levels measured in consumer vehicles were usually traced to sealing issues caused by rear crash damage where the repairs did not ensure sealing integrity. The most recent FordeBay FSA procedure for both the police (17B25) and consumer vehicles (17N03) includes an HVAC reprogramming operation. Tests by FordeBay and NHTSA have demonstrated a substantial reduction of CO levels due solely to the HVAC reprogramming. Other FSA repairs also demonstrated measurable contributions to CO level reductions during controlled tests.Throughout the investigation, vehicles accurately measured with higher levels of carbon monoxide were almost always affected by upfitter alterations, damage, or other causes compromising rear passenger cabin seals.NHTSA received thousands of reports alleging odors which triggered a variety of physiological responses, predominately nausea, headaches, and lightheadedness. NHTSA focused the investigation on accurately measuring vehicle CO levels, and accurately measuring carboxyhemoglobin (COHB) levels from properly administered blood tests. Using rigorous test methods to produce exhaust gas intrusion in vehicles with a properly performed FSA, occupant compartment CO levels remained below current environmental limits for CO in any environment (EPA ambient air quality standards). Furthermore, even without FSA repairs, no vehicles unaffected by upfitter issues or prior crash damage were identified with CO levels that exceed accepted occupational CO exposure levels. This investigation finds that the 2011-2017 FordeBay Explorer vehicles when accurately measured produce occupant compartment CO levels which fall below current accepted health standards, and could not identify COHB levels for vehicle drivers or other occupants, which exceeded thresholds for acute physiological effects. June 5, 2017, JaycoeBay, Inc. (JaycoeBay) notified NHTSA of a safety-related defect in certain 2017 Jay Flight Bungalow, Hummingbird, White Hawk, Jay Flight SLX, Jay Feather 7, Jay Feather and Jay Flight fifth wheel recreational trailers. A recall, 17V-290 was filed. According to the Report, the trailers are equipped with LED ceiling lights that produce extreme high temperature during normal use which may cause light failure. Some of the failure characteristics noted are melting of the plastic housing, smoldering, and charred and scorched ceiling panels. The excessive heat from the LED ceiling lights may increase the risk of a fire.JaycoeBay identified Command Electronics, Inc. (Command) as the supplier of the ceiling lights. Command has indicated that it supplied the same component to other manufacturers, but has not yet filed a defect information report in accordance with 49 C.F.R. ?573.3(f).RMD opened EQ investigation in 07/21/2017 to obtain information regarding the additional manufacturers that were supplied with the component identified by JaycoeBay, and to determine whether additional safety recalls are required by any of those identified companies.Two years past, RMD found not enough evidences that the same LED ceiling lights would produce extreme high temperature during normal use from other users beside JaycoeBay, Inc. Summary Description: Fuel Filter Flange May Crack


Summary

Over the span of a number of months in later 2016 and mid-2017, automakers VolkswageneBay, AudieBay and PorscheeBay filed four safety recall notifications and information reports (16V-660, 17V-151, 17-V289 and 17V-298) concerning fuel leaks in certain VWeBay, AudieBay, and PorscheeBay vehicle products. According to these manufacturers, the vehicles were equipped with fuel pump flanges that could over time develop small cracks or fissures allowing fuel to leak in vaporous or liquid state. The leaks could, in the presence of an ignition source, have the potential to cause a vehicle fire.In June 2017, at the request of the Recall Management Division (RMD), the supplier of the fuel flanges, ContinentaleBay Automotive Systems, Inc. (ContinentaleBay), filed its safety recall notification and information report (17E-031).ContinentaleBay limited its defect decision to the fuel flanges supplied to VWeBay, AudieBay and PorscheeBay products under the existing recalls, but as required by regulation identified other automaker purchasers that used potentially similar fuel flanges manufactured from the same material, an industry standard material known as Polyoxymethylen-Copolymer (POM).ContinentaleBay acknowledged that a root cause for the leaks have not been determined, but it believed environmental factors such as acids from cleaning solutions or other sources, were a factor, an observation also identified by VWeBay, AudieBay and PorscheeBay.ContinentaleBay also identified that there were specific differences in design and application between vehicle manufacturers, and the installed location of the fuel flange were considered other pertinent factors.RMD opened this Equipment Query (EQ) investigation in order to obtain additional information to identify whether other automaker products might be at risk of fuel leakage and, if so to pursue additional safety recalls where needed.Accordingly, an information request (IR) was issued to ContinentaleBay in September 2017, for it to provide additional data and information to explain the distinctions between the recalled fuel flanges and the not recalled population.On September 26, 2017, ContinentaleBay submitted a partial response to the IR.It then provided updates on October 9, 2017, and October 18, 2017, to complete its response.In the meantime, ContinentaleBay continued its review of the scoping of its defect decision and report.ContinentaleBay's additional evaluation eventually resulted in an amended recall report in which the company stated it had confirmed the scoping identified by VWeBay, AudieBay and PorscheeBay was correct given the lack of field incidents with any non-recalled fuel flanges, and due to the differences in design and application between the recalled products and the non-recalled ones.This amendment was submitted in December 2017.RMD, with the support of several of the Office of Defects Investigation (ODI) investigating offices, reviewed ContinentaleBay's IR responses and the data and testing results appended to them.The information at this juncture indicates ContinentaleBay's scoping of its recall decision is appropriate and expenditure of further resources to pursue additional safety recalls from other automakers is not warranted.Accordingly, this equipment query investigation is closed.

Summary Description: Lazydays RV Retail Delivery Issue


Summary

NHTSA opened AQ17-003 to determine whether Lazydays RV of Seffner, Florida (Lazydays) has complied with the requirements of the National Traffic and Motor Vehicle Safety Act, 49 U.S.C. Chapter 301 (Safety Act) and its implementing regulations. NHTSA received information suggesting Lazydays delivered a new WinnebagoeBay recreational vehicle (RV) without having remedied a recall. The Safety Act requires, among other things, that a manufacturer notify its dealers of defects related to motor vehicle safety and noncompliances with Federal Motor Vehicle Safety Standards and, in turn, that a dealer not deliver a new vehicle subject to a recall unless the recall remedy has been performed (49 U.S.C. 30120(i)). In June 2017, NHTSA issued information request (IR) letters to Lazydays and WinnebagoeBay Industries, Inc. (WinnebagoeBay), and again to Lazydays in August 2017. NHTSA's investigation indicated that Lazydays delivered at least seven recalled vehicles that did not have the recall remedy completed at the time the vehicles were delivered to the customers. On May 3, 2022, NHTSA entered into a Settlement Agreement with Lazydays to resolve the Audit Query. In the agreement, Lazydays agreed to pay a $45,000 civil penalty and to certain training and auditing requirements. Specifically, Lazydays committed to mandatory employee training regarding the delivery of new vehicles with open recalls and the implementation of new vehicle sale and delivery process controls at its dealership and any newly acquired dealerships.This Audit Query is closed.
