NHTSA opened this audit query to determine whether Zipcar, Inc. (Zipcar) complied with the requirements of the National Traffic and Motor Vehicle Safety Act (Safety Act). The Safety Act requires, among other things, that a rental car company not rent, lease, or sell a recalled vehicle until the safety defect or noncompliance is remedied. 49 U.S.C. 30120(i). Based on NHTSA's inquiry, including information provided by Zipcar, NHTSA asserted that, during 2017 and 2018, Zipcar rented certain unremedied recalled vehicles in violation of the Safety Act. In October 2023, NHTSA and Zipcar entered into a Consent Order in which Zipcar agreed to pay a total civil penalty of $300,000. The total civil penalty included a payment of $150,000 as a Non-Deferred Amount. Zipcar also agreed to a sum of $150,000 as an Abeyance Amount, to be deferred and held in abeyance pending its satisfactory completion, as reasonably determined by NHTSA, of the requirements of the Consent Order. The requirements of the Consent Order include performance obligations that relate to process improvements to Zipcar's recall compliance procedures and its training materials. Zipcar agreed to conduct an audit of all Zipcar vehicles with an open recall within 150 days after the Effective Date of the Consent Order. Zipcar also agreed to quarterly meetings with NHTSA staff to discuss the progress of the performance obligations and issues or concerns from either party. This audit query investigation, AQ18001, is closed. Closure of this AQ has no bearing on the terms of the Consent Order, including Zipcar's ongoing performance obligations or other legal obligations, and does not represent a determination by NHTSA about Zipcar's performance under the Consent Order to date.

Motor America (HMA) issued recall No. 18V-137 for MY 2011-2013 Sonata and MY 2012 Sonata Hybrid
vehicles. Kia
Motors America (KMA) issued recall No. 18V-363 for MY 2010-2013 Kia
Forte and Forte Koup, MY 2011-2013 Optima, MY 2011-2012 Optima Hybrid
, and MY2011-2012 Sedona vehicles. The two recalls address vehicles containing ACUs manufactured without adequate circuit protection by installing a wire harness filter kit to prevent internal damage to the ACU. In the event of a crash, ACU damage may result in the disablement of the vehicle's airbags. Each respective manufacturer has mailed letters to affected vehicle owners informing them of the remedy and its availability. ODI plans to evaluate the susceptibility of the subject ACU to electrical signals, as well as other vehicle factors that can either lead to, or reduce the likelihood of, an electrical overstress event in other vehicles manufactured with the subject ZF ACU.Accordingly, this Preliminary Evaluation has been upgraded to an Engineering Analysis (EA19-001), to expand the scope of the investigation to include the Tier-one supplier and any manufacturers who installed the subject ACU in production vehicles. On November 27, 2018, Daimler Vans USA, LLC submitted a Defect Information Report (DIR) to NHTSA describing two engine compartment fuel hose connection defects in certain model year (MY) 2016 and 2017 Mercedes-Benz
Metris vehicles (Recall 18V-837).The recall scope includes approximately 12,383 Metris vehicles manufactured from March 2, 2015 (SOP) to March 15, 2017.The defects may result in leakage from an upper hose connection that feeds the high-pressure fuel pump or from a lower hose connection of the fuel transition hose between the underbody fuel line and the Shrader valve.The upper connection defect was caused by thermal aging of the hose material (Veritas hose), resulting in a loss of elasticity over time.The thermal aging of the hose leads to a progressive reduction of sealing performance, which is most evident at low ambient temperatures.The problem was corrected by changing to a hose with better material properties (ContiTech hose).The lower connection defect was caused by a manufacturing process problem, where the hose clamp may have been installed using an incorrect tool.The recall remedy involves replacing the upper and lower hoses and clamps, as necessary, and ensuring proper installation. The Office of Defects Investigation (ODI) opened Preliminary Evaluation PE18-002 to investigate nine (9) complaints (VOQs) reporting incidents of gasoline odor or leakage in nine (9) model year (MY) 2016 Mercedes-Benz
Metris vans (subject vehicles).Eight (8) of the VOQs indicated that the problem occurred in cold ambient temperatures, either during engine warm-up after a cold start or after the vehicle had been parked and shutoff. Two (2) of the consumers have indicated to ODI that the problems were diagnosed by dealer service technicians as the upper hose connection defect.As part of PE18-002, ODI analyzed information related to the incidents reported to the Office by consumers and analyzed the information provided by Daimler Vans
in response to ODI's information request letter.The fuel hose leak field experience shown in the Failure Report section of this resume all involve vehicles covered by the Daimler Vans

In December 2017, NHTSA conducted two New Car Assessment Program (NCAP) tests on the 2018 MY Volkswagen (VW
) Tiguan. Both tests were 35 mph, full frontal impacts into a rigid barrier with a 50th percentile male dummy seat-belted in the driver position and a 5th percentile female seat-belted in the right front-passenger position. The tests were conducted on December 8, 2017 at MGA Research Corp. in Wisconsin (MGA) and December 13, 2017 at the Transportation Research Center of Ohio (TRC).During both crash tests, the driver seat belt webbing completely separated in tension where it looped through the seat belt latch tongue (see attached photos). Based on its analysis of the NCAP test results, VW
asserted that the test dummy umbilical cord exerted additional forces on the seat belt system causing the separation. To support this theory, VW
conducted several sled tests.The Office of Defects Investigation (ODI) opened a Preliminary Evaluation (PE18-001) on 01/10/2018 to evaluate the two (2) incidents of seat belt separation. ODI and NCAP reviewed the sled test data submitted by VW
in support of their theory. Micro analysis, conducted by the Materials Laboratory at the National Transportation Safety Board (NTSB), verified the seat belts failed in tension and not due to cuts or abrasion.PE18-001 has been upgraded to an Engineering Analysis (EA18-005) to further examine seat belt behavior in the subject vehicles and to determine, among other things, a root cause for the seat belt separation. ODI will perform a thorough review of any vehicle and seat belt design changes for the new 2018 MY Tiguan platform and their effects on the performance of the seat belt system.

G159 275/70R22.5 tires installed on Class-A motorhomes failed in service, causing deaths or personal injuries. The number of these claims suggests that the failures may stem from a safety related defect. Many of these claims were not required to be reported under 49 CFR Part 579 and the data produced in litigation was sealed under protective orders and confidential settlement agreements, precluding claimants from submitting it to NHTSA.The Office of Defects investigation has also received 10 consumer complaints alleging failures of Goodyear
G159 275/70R22.5 tires on motorhomes. Two of these complaints allege a crash occurred as a result of the tire failures. Goodyear
separately reported 9 claims under 49 CFR Part 579 alleging 1 death and 13 injuries.NHTSA's Office of Defects Investigation (ODI) opened a Preliminary Evaluation to investigate allegations of tire failures and to request certain information. Analysis of the data provided by Goodyear
showed high failure frequency when these tires used on motorhomes. The findings of ODI's investigation are further detailed in the agency's recall request letter sent to Goodyear
, dated February 22, 2022, and available in the PE17-009 investigation file. In response to this investigation, Goodyear
filed safety recall 22T-009 covering G159 275/70R22.5 tires manufactured between February 1, 1996, and January 31, 2003. This recall covers the entire period of production for these tires. These tires experienced tread separations and other failures when exposed to foreseeable conditions present in use on motorhomes, including overloading and underinflation.The recall action addresses the safety concern that led to the opening of this investigation. Therefore, this investigation is closed. The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist in other model and size tires outside of the recall scope.The agency reserves the right to take further action if warranted by the circumstances.
