On November 20, 2018, the Office of Defects Investigations (ODI) opened PE18-012 to investigate instances of sudden onset of a hard brake pedal that could result in extended stopping distance due to an issue with the brake assist vacuum pump in model year (MY) 2014 through 2016 GMC Sierra 1500 and Chevrolet
Silverado 1500 series pickup trucks and MY 2015 through 2016 Cadillac
Escalade, Chevrolet
Suburban, Chevrolet
Tahoe, and GMC
Yukon SUVs.If the brake assist vacuum pump fails to operate as intended, the amount of brake power assist supplied to the driver can be significantly reduced, extending the subject vehicle stopping distance. GM stated that the root cause of pump failures was due to foreign debris such as oil sludge in the engine oil. GM stated that this debris can become trapped by the oil inlet filter screen. Under normal operation, this screen allows a small amount of oil into the brake vacuum pump. The foreign debris can, over time, clog the pump which can cause a loss of lubrication and a reduction in the amount of vacuum produced leading to a hard pedal and extended stopping distance.On December 13, 2018, GM issued a Special Coverage (N182202780) for the brake vacuum pump issue in MY 2014-2017 trucks and 2015-2017 SUVs on the K2XX platform for 6 years or 72,000 miles. Special Coverage repair includes the replacement of the vacuum pump and vacuum pump belt. Consumers received notification of the coverage via mail. On September 6, 2019, GM notified NHTSA that it was conducting safety recall 19V-645 which reprograms the electronic brake control module (EBCM) and included approximately 3.5 million trucks and SUVs. In October 2019, GM extended the terms of special coverage N182202780 to 10 years or 150,000 miles as well as now including the entire scope of recall 19V-645. In October 2020, GM expanded the scope of coverage N182202780 to include the MY 2018 Escalade and 2019 Tahoe.The remedy implemented in GM recall 19V-645 appears to be sufficient in addressing the safety-related concerns of this issue. Loss of vacuum assist now occurs at a progressive rate as well as there being a more timely warning of a brake problem to the driver through the driver information center (DIC). In view of the recall action and revision to the special coverage, this Preliminary Evaluation is closed. The agency reserves the right to take additional action if warranted by new circumstances. The petitioner described a broad list of frame weld deficiencies, including porous welds, excessive slag, lack of weld penetration, over penetration of welds, overweld or weld drip, and weld splash. The weld defects are allegedly located at a variety of locations on the frame assembly.On November 16, 2018, the Office of Defects Investigation (ODI) opened a Defect Petition (DP18-004) to evaluate whether to grant or deny the petition. . Based on ODI's review of the applicable materials, NHTSA has decided to grant the petition. While reviewing the applicable materials obtained from the manufacturer, ODI identified various reports and references to frame welded component detachments that were outside of the scope of NHTSA Recall No. 18V-675. Additionally, the information that FCA
provided did not adequately address whether frame weld quality deficiencies compromise the structural integrity of vehicles, and therefore may pose an unreasonable risk to motor vehicle safety. Finally, ODI needs to further evaluate the alleged steering-related defects reported through MY 2019 and the alleged defects' relation to weld quality.The petition was granted on September 16, 2019. On November 2, 2018, the Office of Defects Investigation (ODI) opened a Recall Query (RQ18-002) to assess the scope of Recall 16V-582.General Motors (GM) initiated Safety Recall 16V-582 on August 3, 2016 to address windshield wiper failure in the Model Year (MY) 2013 Chevrolet
Equinox and GMC
Terrain. Failures were attributed to water and debris intrusion into the windshield wiper assembly ball joints, leading to excessive wear and eventual detachment of the affected ball joint with an attendant loss of windshield wiper function. The recall remedy addressed these conditions with the installation of an improved windshield wiper motor/transmission assembly and the relocation of a drain hole on the Air Inlet Panel at the base of the windshield.RQ18-002 was opened to assess windshield wiper failure rates in the MY 2010-2012 and MY 2014 - 2016 Equinox and Terrain (subject vehicles).During the course of the investigation, ODI received additional consumer complaint traffic bringing its total to 602 concerning the alleged defect in the subject vehicles. In their December 20, 2018 response to ODI's Information Request (IR) Letter, GM reported 1,303 complaints related to the alleged defect in the subject vehicles. Together, these bodies of data correspond to 1,905 unique Vehicle Identification Numbers (VIN).GM stated the recalled vehicles exhibited double the warranty rate and five times the complaint rate of the subject vehicles and that continuing complaint traffic concerning the alleged defect in the subject vehicles stemmed from publicity surrounding Recall 16V-582.ODI's review of GM's data confirms the stated difference in failure rates between the recalled and subject vehicles. However, ODI believes that the subject vehicle failure rates are nevertheless elevated and that publicity alone cannot account for the continued consumer complaint traffic concerning the alleged defect in the subject vehicles. The National Highway Traffic Safety Administration (NHTSA) and Mercedes-Benz USA LLC (MBUSA) entered a settlement agreement on December 17, 2019 to resolve NHTSA Audit Query number 18-004 (AQ18-004). Notwithstanding MBUSA's explanations and positions, NHTSA determined the following: owner letters for six recalls were mailed beyond the sixty-day deadline from the Part 573 report date; in twenty-two recalls, the final issued copies of owner's letters were not uploaded within the required 5-day time frame; six quarterly reports involving four recalls were not submitted according to the schedule set forth in 49 CFR 573.7(d); fourteen recalls were not updated when owner letter launch dates became available, as required in 49 CFR 573.6(a); and for recalls 18V-405 and 18V-610 NHTSA alleges that MBUSA did not submit the Part 573 report within five business days of when it knew or should have known that the noncompliance existed. NHTSA also raised concerns with MBUSA regarding the efficacy of MBUSA's VIN Lookup Tool with the requirements contained in 49 CFR 573.15.MBUSA has responded, both in writing and through subsequent meetings to all the concerns mentioned above and committed to addressing these concerns moving forward.As part of the settlement agreement, MBUSA agreed to a total civil penalty of $20 million, with $13 million to be paid within 45 days of the effective date of the settlement agreement. Failure to comply with the terms of the settlement agreement will result in portions of the $7 million in abeyance funds coming due. NHTSA acknowledged the efforts made by MBUSA to improve their recall administration, including making substantial financial investments into a new automated recall management tool, and hiring and training personnel. The settlement agreement details how both parties will move forward with quarterly assessment meetings, and address any issues with timely communication.Based on the Settlement Agreement this audit query investigation, AQ18-004, is closed. Closure of this AQ has no bearing on the terms of the Settlement Agreement, including MBUSA's ongoing performance obligations or legal obligations, and does not represent a determination by NHTSA as to MBUSA's performance under the settlement agreement to date.
