THE VEHICLE: 2009 FORD FUSION VIN #[XXX] WAS RECALLED DUE TO DEFECTED ANTI-LOCK BRAKING SYSTEM MY SON PURCHASED THE VEHICLE IN DECEMBER 2018 FROM DRIVE NOW MOTORS, HILLSBOROUGH BLVD, TAMPA (NOW LOCATED ON FLORIDA AVE.) THE OWNER NAME IS SAM. I ADDED THE VEHICLE TO MY EXISTING INSURANCE WITH WINDHAVEN. WE RETURNED THE VEHICLE A FEW WEEKS AFTER PURCHASING DUE TO THE BRAKES NOT WORKING PROPERLY. THE DEALERSHIP MADE SOME ADJUSTMENTS AND TOLD US IT WAS FINE. BUT I CONTINUE TO COMPLAINED AFTER THEY MADE ADJUSTMENT BECAUSE IT STILL DID NOT WORK RIGHT FOR ME, BUT THE OWNER DID NOT WANT TO HELP US ANY FURTHER. ON APRIL 10, 2019, THE CAR WAS TOTALED WHEN MY SON LOST CONTROL OF THE CAR DRIVING INTO OUR COMMUNITY WALL. WE REPORTED THE ACCIDENT TO WINDHAVEN INSURANCE; THEY OPENED THE CLAIM BUT WE HEARD NOTHING ELSE ABOUT IT. THEY DID PAY FOR THE WALL REPAIR IN OUR COMMUNITY. ALMOST A YEAR LATER, WE RECEIVED THE SAFETY RECALL NOTICE FROM FORD (IN JANUARY, 2020). I CONTACTED WINDHAVEN AGAIN AND WAS TOLD THE STATE (FIGA) WAS HANDLING THIS CLAIM, AND GIVEN THE 800# TO GET MORE INFORMATION. AFTER MAKING NUMEROUS CONTACT WITH THE FIGA, I WAS TOLD MY INSURANCE WAS CANCELLED BECAUSE WINDHAVEN WENT OUT OF BUSINESS; AND I HAD TO SEND AN EMAIL TO REQUEST MY CLAIM BE REOPENED AND INVESTIGATED WITH THIS NEW (RECALL) INFORMATION. I ALSO CONTACTED FORD MANUFACTURER ABOUT THE RECALL AND THE BRAKES PROBLEMS THAT LED TO THE ACCIDENT. THE REPRESENTATIVE TOOK MY INFORMATION AND SAID HE WILL INVESTIGATE AND CONTACT ME, BUT I NEVER HEARD BACK FROM THEM. I, THEREFORE, CONTACTED FIGA AGAIN AND WAS EVENTUALLY REFERRED TO AN ADJUSTER. WHEN I TOOK POSSESSION AND STARTED THE VEHICLE AT CHAPMAN LAS VEGAS IT MISFIRED (UNCONTROLLABLY SHAKING) AND THE CHECK ENGINE LIGHT TURNED ON. DEALER ENDED UP KEEPING VEHICLE ANOTHER DAY TO INSPECT MISFIRE/CHECK ENGINE LIGHT ISSUE. ACCORDING TO CHAPMAN LAS VEGAS THEY COULD NOT IDENTIFY THE REASON FOR THE MISFIRE/CHECK ENGINE LIGHT AND HAD ME PICK UP THE VEHICLE THE NEXT DAY. EVER SINCE THAT INCIDENT THE VEHICLE HAS BECOME UNSTABLE AND CONSTANTLY SHAKES. I WAS ADVISE BY CHAPMAN LAS VEGAS TO "CONTINUE DRIVING THE VEHICLE UNTIL ENGINE LIGHT COMES ON" AS THEY CAN'T FIGURE OUT THE PROBLEM FOR THE CONTINUED SHAKING. THIS HAS BEEN GOING ON FOR A FEW WEEKS NOW. I DO NOT FEEL SAFE CONTINUING TO DRIVE A DEFECTIVE VEHICLE. I'M NOW STARTING TO FEEL AND HEAR RATTLING SOUNDS WHILE MAKING TURNS.
