On January 21, 2010, Toyota
notified the NHTSA that it had decided certain model year 2007-2010 Toyota vehicles and certain MY 2009-2010 Pontiac vehicles contain a safety-related defect.Toyota stated that the accelerator pedal assemblies in those vehicles may become hard to depress, slow to return to idle when released, or may remain mechanically stuck in a partially depressed condition, increasing the risk of a vehicle crash.Further, Toyota stated that CTS Corporation (CTS) was the fabricating manufacturer of the defective accelerator pedal assemblies.NHTSA assigned recall number 10V-017 to this matter.RMD mailed an IR letter to CTS on February 1, 2010 with 23 questions regarding the recalled accelerator pedals.The IR questions requested information such as quantities manufactured, complete customer lists, part number changes, test results, chronologies, and extensive communications between CTS and Toyota.The letter also asked if CTS planned to notify its purchasers of a safety-related defect in its accelerator pedals.RMD requested that the first 7 questions, those involving customers and quantities, be answered by February 3, 2010 and the remaining questions within 30 days.After a granted extension request, CTS submitted its response to the first 7 questions on February 5, 2010.Confidentiality was granted by NHTSA's Chief Counsel's Office, but CTS detailed its customer list for all manufacturers it has sold accelerator pedals and listed all quantities sold.It was noted that subject pedals, those recalled by Toyota for containing a friction element of PPS or PA 4/6 material, were not sold to any other vehicle manufacturer. CTS officials chose to travel to U.S. DOT on February 17, 2010 to meet with ODI personnel.CTS explained the history of producing accelerator pedals for Toyota and expanded on the construction of the recalled pedals.CTS explained the recall issue with example pedals and test videos and asserted that unintended acceleration and a slower return to idle are not the same problem.CTS expressed that, in its opinion, unintended acceleration is not an issue with this pedal design, but, in rare cases in high humidity, there might be a slight delay in the return to idle position and that the pedal met the requirements of the applicable FMVSS even in that situation.After another extension request in early March 2010, CTS was allowed to produce the answers to the remaining IR questions on a time table ending on April 30, 2010.Extensive records were submitted including long e-mail strings between CTS, CTS Japan, and various global Toyota organizations.Detailed accelerator pedal diagrams, testing procedures and results, pictures, videos, field return records, and warranty rate information were all submitted as requested.NHTSA's Office of the Chief Counsel notified CTS on April 27, 2010 to submit everything that it had prepared already, but not to gather any further information unless requested by the agency.Virtually all of CTS' submissions were granted confidentiality as they contained sensitive business and commercial information.However, the core question of an Equipment Query investigation, whether the same or similar equipment was sold to any other vehicle manufacturer for inclusion in a new motor vehicle, was given in CTS' original submission on February 5, 2010.CTS did sell accelerator pedal assemblies to other vehicle manufacturers, but they were pedals of a different design consisting of different materials than those at issue in Toyota recall 10V-017 (and GM recall 10V-018 for the Pontiac Vibe).(Continued on attachment)

On July 30, 2008, Ricon reported that certain 6-way power seat bases, produced between January 1, 2006 and May 14, 2007, contain a weld on the pivot shaft that may fail due to poor (cold) welding.A failed pivot shaft weld can cause the driver's seat to become detached from the seat base, possibly causing injury to the driver and increasing the risk of a crash.NHTSA assigned recall number 08E-046 to this matter.On February 5, 2010, the Recall Management Department (RMD) requested Ricon provide its customer list of all recipients that purchased the defective seat bases.Ricon did not respond.After several e-mail exchanges and a second IR letter mailed on April 2, 2010, Ricon responded with its customer list on April 9, 2010.RMD mailed IR letters to the 10 companies on Ricon's list.Those being: Siebert Mobility, Hoglund Bus Co., Inc., Ilderton Conversion Co, New England Wheels Inc, Northern Bus Sales, Inc., Sunset Vans, Inc., The Mobility Specialist, Thomas Bus Sales of IA, Vantage Mobility International, Malley Industries Inc.Only The Mobility Specialist filed a subsequent Defect Report with NHTSA for new vehicles it modified with these seat bases.It was assigned recall number 10V-270.RMD received responses from nine of the above companies.Eight of those companies were not required to file a Defect Report for their units for the following reasons:Hoglund Bus Co and Northern Bus Sales, Inc. sold their units over the counter and did not install the units.Siebert Mobility purchased only the assets from the former Arkansas Convention Center and Siebert was not provided any sales records for customer contact.Ilderton Conversion Co and Thomas Bus Sales of IA did not actually perform their installations but contracted them out to other companies.New England Wheels only installed their units on used vehicles.Malley Industries Inc. installed their unit on a Canadian vehicle.Vantage Mobility International (VMI) is a distributor that re-sold their units to 250 dealers.VMI did not file a Defect Report, as distributors are not required by regulation to do so, but did provide copies of the letters mailed to its dealer body.VMI's letters included verbiage about subsequent reporting responsibilities the dealers might have if they altered new vehicles and also included a template Defect Report for their convenience.Only three of VMI's dealers filed subsequent Defect Reports with NHTSA.They were: Arizona Mobility (10V-261), All in One Mobility (10V-271), Driving Specialties (10V-338).Only Sunset Vans, Inc. did not respond to RMD's April 20, 2010 IR letter.Another IR letter was sent to Sunset Vans on May 26, 2010.Phone calls and e-mail exchanges with Sunset Vans on September 1, 2010 did not motivate a response submission.A third IR letter was mailed on October 1, 2010.No response was received.Sunset Vans, Inc.'s lack of a response to RMD's recall inquiry will be forwarded to NHTSA's Office of the Chief Counsel for further enforcement consideration and action.This EQ is closed.

We opened this PE based on a single complaint of rapid fuel expulsion while re-fueling from the owner of a Buell 1125CR.After opening this PE, we contacted other owners, Buell dealer service departments and monitored activity of various Buell-related web forums.While Harley Davidson (Buell was a subsidiary) has no owner complaints, it did receive four warranty claims related to this issue.Two involve the fuel line check valve, one a pinched fuel vent hose, and one saturated charcoal cannister due to over-fill.Currently, the data does not indicate a trending safety defect exists.We will continue to monitor this issue and take action as appropriate.

In February 2007, Hyosung launched recall 07V-015 addressing fractures of handlebar fasteners on MY 2006 GV650 model motorcycles.In some instances, the handlebar could then separate from the front fork.ODI received a Vehicle Owner Questionnaire (VOQ) alleging a MY 2007 Hyosung GV650 had the same issue, i.e., fractured handlebar retaining bolts.To explore the adequacy of Hyosung?s recall scope, we opened this Recall Query (RQ).Since opening, we interviewed Hyosung dealer service personnel, continued monitoring related web-forums and media, and reviewed Hyosung's response to our information request.Currently, we are only aware of the incident prompting this RQ and, consequently find no defect trend exists justifying expanding the scope of 07V-015 to include the 2007 model year GV650's.Therefore, this Preliminary Evaluation is closed. We will continue to monitor these motorcycles for any changes in the complaint trends.
